Fiveash hearing delayed

Court proceedings in the case of Brandon Fiveash, the deputy who was forced to surrender his gun after he was accused of domestic violence, have been delayed for a second time.

Fiveash stands accused of abuse of his 4-year-old daughter and of his former girlfriend, who filed an injunction against him in May. At that time, the courts granted her a temporary protective order pending a court hearing.

Part of that order required that Fiveash not have access to weapons, so he was taken off road patrol and reassigned to administrative duties pending the court hearing.

Flagler County Sheriff Jim Manfre said in May that he would determine how to handle Fiveash’s employment depending on what the courts decide and whether charges are brought against him.

Fiveash’s case was pushed back until next week because a witness was unavailable to testify on Thursday, the original date of the hearing. A judge set another hearing tentatively for 9 a.m. June 27, but that time may change subject to the schedules of attorneys involved in the case.

Fiveash’s former girlfriend said that starting in 2008, when she was pregnant, Fiveash became physically and emotionally abusive. After her daughter was born, the woman said she witnessed Fiveash beating the child as well.

The woman said she never called the police because of Fiveash’s position in the Sheriff’s Office, but she did make visits to the Family Life Center, which serves victims of domestic abuse, to ask about her options and about the process of filing an injunction.

Until the matter is decided, Fiveash will remain on administrative duties. However, because no charges have been brought against him and because the case has now been continued twice, a judge ordered that Fiveash be granted a supervised visit with his daughter over the weekend, meaning that the two will not spend any time alone together.
