UPDATE 4:00 p.m.: The state will not pursue the charge of tampering with evidence against Pace. The acting chief will only face a misdemeanor charge for obstruction of justice.
The State Attorney’s Office will pursue a charge of obstruction of justice against Robert Pace, acting Flagler Beach fire chief, according to Klare Ly, a spokesperson for the State Attorney’s Office.
A written complaint was filed against Pace, 41, in April for one count of tampering with evidence (a felony) and one count of obstruction of justice: resisting an officer without violence (a misdemeanor).
On Thursday, the State Attorney’s Office filed an information document for the obstruction charge, indicating that prosecutors will move forward with the case. The state has not yet decided if it will pursue the tampering with evidence charge.
The charges arose when Pace was accused of erasing video surveillance relating to an internal investigation that then-Fire Chief Martin Roberts launched against Pace.
