The state has named 45 witnesses in the case against former Flagler County elections supervisor Kimberle Weeks, who faces 12 felony counts in connection with the surreptitious audio recording of officials and others — including Florida Secretary of State Ken Detzner, County Judge Melissa Moore Stens and Flagler county commissioners — during the time she was in office.
Weeks' attorneys are still wading through information for the case, and need time to schedule depositions for the numerous witnesses before it goes to trial, attorney Dean Bartzokis told judge Margaret Hudson in a second pretrial hearing at the county courthouse the afternoon of Oct. 23.
"No depositions have taken place," he said. "There’s a lot of discovery, and a lot of witnesses." Bartzokis was standing in during the pretrial for Weeks' primary attorney, Joerg Jaeger of the law firm of Jaeger and Blankner.
The state attorney's office agreed to a timeframe that would allow the defense more time, and Hudson said she could schedule a pretrial for mid-January. It was ultimately scheduled for 1:30 p.m. Jan. 15.
"I want that discovery schedule to at least be started and outlined (by the next pretrial), so we can start looking at the appropriate timeframes and trial periods," she said.
Weeks faces seven counts of intercepting oral communication and five counts of invasion of privacy by illegal disclosure of communication. She was not present in court for the two pretrials held so far.
County Attorney Al Hadeed and County Commissioner Charlie, two of the county officials Weeks is charged with recording surreptitiously, attended the pretrial hearing.
