No crime committed in 2019 death of Anthony Fennick at Flagler jail, FDLE says

The Sheriff's Office will now investigate whether staff followed protocols.

The Florida Department of Law Enforcement has determined that no crime was committed in the case of Anthony Fennick, who suffered a medical episode on Feb. 4, 2019, while he was an inmate at the Sheriff Perry Hall Inmate Detention Facility. He was transported to the hospital, where he died on Feb. 9, 2019.

The Flagler County Sheriff’s Office conducted a criminal investigation into the death and found no evidence of any crime. Although not required to do so, Sheriff Rick Staly insisted that there be an independent outside investigation by FDLE. The FCSO received the conclusion of the FDLE investigation on June 19, 2020, which also concluded there is no evidence of any crime. The criminal investigation has now been turned over to the State Attorney’s Office for review.

Sheriff Staly further requested that the Medical Examiner and an independent outside physician conduct investigations into the death of Mr. Fennick. Both concluded there was no evidence of a crime. The reviews by medical experts believe the evidence suggests the former medical provider failed to recognize that Mr. Fennick was having a reaction to medicine they had prescribed to him and the seriousness of his illness.

With the conclusion of the criminal investigations, the FCSO will now initiate a professional standards internal investigation which focuses on any potential administrative or policy issue involving any FCSO employee.

The findings of the internal investigation will be made public as soon as it is completed. Any policy issues found during the investigation will be promptly addressed by the sheriff and his staff.

“We have been open and transparent throughout this process and we will continue to be,” Staly said. “We grieve with the Fennick family who has experienced a terrible tragedy."
