Flagler Beach patrolman Brett Smith was arrested Saturday, March 12, on a DUI charge after Flagler County Sheriff’s deputies found Smith passed out in his personal vehicle around 5:40 p.m. in the Daytona North area.

Smith, 31, has since been placed on administrative leave, Flagler Beach Police Chief Dan Cody said Tuesday in a phone interview.

“It was upsetting,” Cody said. “Anytime you hear one of your officers getting into trouble for having problems, it’s upsetting.”

According to the arrest report, Smith was “unresponsive behind the wheel possibly in need of medical assistance.”

The report also states Smith’s speech was “slurred and thick-tongued.”

FCSO deputies also found an open but empty 12-ounce bottle of Bud Light Lime with a small amount of liquid remaining. “In (Smith's) right front pocket, I found a bottle cap for Bud Light Lime,” the arrest report continues. A case of beer was also found in the car with a receipt dated Saturday, March 12, with several bottles missing. Smith failed several field sobriety tests.

Smith was booked into the Flagler County Inmate Facility and was released after posting $350 bond, according to a press release by the Flagler County Sheriff’s Office.
