East Flagler Mosquito Control race left off some mail and early voting ballots

A supplemental ballot will be mailed to the affected voters by Monday, Oct. 31.

Flagler County voters in precincts 29, 33, 35 and three smaller precinct splits received a ballot by mail or during early voting which did not include the East Flagler Mosquito Control District, Seat 3 race, according to a Supervisor of Elections Office news release.

The missing race is due to a ballot ordering error and to the complex ballot styles involved with the East Flagler Mosquito Control district race. 

The eligible number of registered voters within the district is 74,049, and the number affected by the error is less than 2.7% of voters eligible to vote in the race.
 
The issue was immediately corrected and voters casting their ballot early, by mail or on Election Day, will all receive the correct ballot style for their precinct. All votes in all races will be counted.
 
A supplemental ballot will be mailed to the affected voters by Monday, Oct. 31. The supplemental ballot will include only one race and the votes for this district will be counted separately from the 2016 General Election results. 

No other race on the ballot will be affected. The election results for this election will not be affected by the supplemental ballot.
 
There is no solution in the law and no clear precedent by FAC Rule or Division Formal Opinion which provides direction for Supervisors of Elections in the state of Florida for this type of anomaly. 
 
Elections Supervisor Kaiti Lenhart’s solution has been supported by the FSASE General Counsel, the Flagler County attorney’s office and the candidates involved. 

Lenhart will make herself available during the election for any questions, although there may be a delay as the elections team is busy at the office. The Flagler County Supervisor of Elections Office’s main phone number is 386-313-4170.
 
Again, no other race on the ballot will be affected. The election results for this election will not be affected by the supplemental ballot.
