Marc Dwyer, the attorney representing the 76-year-old driver who crashed in to the Palm Coast Publix April 14, said an investigation will be conducted on the Toyota Camry.

“We have reason to believe there was a malfunction in the car,” Dwyer said.

The Florida Highway Patrol has filed careless driving charges against Thelma Wagenhoffer. Ten people were injured in the crash.

The State Attorney’s Office said careless driving is not a criminal infraction, and so although Wagenhoffer has a mandatory hearing in court due to the severity of the injuries, the state is not involved in the case at all and so won’t be prosecuting.

Dwyer said his client is “heartbroken” over the incident. “She’s really concerned for those who got injured and she’s praying for them,” he said. “She’s very distressed. … We appreciate people giving her space to deal with the trauma herself, and hopefully everyone will recover.”
