Fiveash cleared, returned to road patrol

A Flagler deputy accused of domestic violence has been cleared and returned to road patrol.

Deputy Brandon Fiveash was accused of being physically abusive to his former girlfriend in May, when she filed a petition for an injunction for protection against him. She later dropped her petition during a court hearing and agreed to resolve her issues with Fiveash through family law proceedings, not through felony court.

However, because the accusations had been made, the Florida Department of Law Enforcement continued an investigation.

After the investigation concluded, the State Attorney’s Office decided not to prosecute Fiveash because there was “insufficient evidence to prove beyond reasonable doubt” that Fiveash had broken the law, said Klare Ly, public information officer for the State Attorney’s Office.

When the accusations came against Fiveash, his gun was taken from him and he was taken off road patrol and assigned to administrative duties. His weapons were returned to him in June after the petition against him was dropped, but he remained assigned to administrative duties pending the FDLE investigation’s conclusion.

Fiveash has now been reassigned to road patrol, said Lt. Robert Weber, public information officer for the Flagler County Sheriff’s Office.
